RMA Plasma (RMA Plasma LLC) is committed to maintaining the highest standards of safety, regulatory compliance, and ethical conduct in its plasma collection operations. However, by participating in plasma donation or engaging in any business partnerships with RMA Plasma (RMA Plasma LLC), all parties agree to the following terms of liability protection:
- Medical Risks and Donor Acknowledgment
Plasma donation is a generally safe procedure when conducted according to regulatory guidelines. Donors participate voluntarily and acknowledge that, despite adherence to strict safety protocols, there may be inherent risks, including but not limited to bruising, dizziness, or other minor side effects.
RMA Plasma (RMA Plasma LLC) and its affiliates are not liable for any unforeseen medical complications arising from the donation process, provided that the procedure was performed in compliance with industry regulations and accepted medical standards.
- Use of Donated Plasma
Donors acknowledge and agree that their donated plasma may be used for research, diagnostics, therapeutic development, or other lawful purposes. Once plasma is donated, RMA Plasma (RMA Plasma LLC) assumes full ownership and responsibility for its handling and utilization. Donors waive any claims regarding how their plasma is used, provided its use complies with applicable laws and regulations.
- Business Partnerships
Any research, diagnostic, or pharmaceutical partner engaging in the use of plasma products supplied by RMA Plasma (RMA Plasma LLC) agrees to indemnify and hold harmless RMA Plasma (RMA Plasma LLC), its officers, employees, and affiliates from any claims, damages, or liabilities arising from the improper handling, use, or application of plasma products once they are transferred to the partner’s custody.
- RMA Plasma as a Supplier, Not a Donation Center
RMA Plasma (RMA Plasma LLC) operates solely as a biomedical supplier and not as a plasma donation center. Plasma is procured from third-party donation centers that are responsible for donor recruitment, plasma collection, and compensation. RMA Plasma (RMA Plasma LLC) is not responsible for compensating donors or managing the donation process.
- Regulatory Compliance
RMA Plasma (RMA Plasma LLC) operates in compliance with all relevant local, national, and international regulations, including but not limited to the guidelines of the Food and Drug Administration (FDA) and the European Medicines Agency (EMA). RMA Plasma (RMA Plasma LLC) is not liable for delays, interruptions, or other issues arising from regulatory changes or unforeseen circumstances beyond its control.
- Limitation of Damages
To the fullest extent permitted by law, RMA Plasma (RMA Plasma LLC) shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from plasma donation or partnership engagements. This includes, but is not limited to, lost profits, business interruptions, or other economic losses.
- Force Majeure
RMA Plasma (RMA Plasma LLC) is not liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, government actions, pandemics, labor strikes, or acts of terrorism.
- Governing Law and Dispute Resolution
This liability protection statement is governed by the laws of the City of Charlotte and the State of North Carolina. Any disputes arising from plasma donation or business engagements with RMA Plasma (RMA Plasma LLC) shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), with the venue set in Charlotte, NC.
By donating plasma or entering into a partnership with RMA Plasma (RMA Plasma LLC), all parties acknowledge that they have read, understood, and agreed to the terms outlined in this liability protection statement.
